These Terms & Conditions ("Terms") govern your use of the Daily English Journal service ("Service") operated by Engs.today, located at 1900 Brentwood Dr., Fullerton, CA 92831, USA ("we", "us", or "our"). By accessing or continuing to use the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

Daily English Journal is a journaling application that helps users improve their English writing through daily entries and AI-generated feedback on grammar, vocabulary, and natural expression.

2. Eligibility & Account

You must be of legal age in your jurisdiction to use the Service. You agree to provide accurate information, keep your account credentials confidential, and are responsible for all activity under your account.

3. Acceptable Use

You agree not to misuse the Service. You must not:

  • Use the Service for any unlawful purpose, fraud, or spam.
  • Infringe the intellectual property rights of others.
  • Attempt to interfere with the security of the Service (including probing, scraping, or distributing malware).
  • Submit content that is illegal, hateful, defamatory, or otherwise harmful.
  • Attempt to jailbreak, reverse-engineer, or circumvent technical limits of the AI features.

4. AI Features & Outputs

The Service uses generative AI to produce feedback, translations, and suggestions ("AI Outputs"). You are responsible for the prompts and content you submit, for verifying the accuracy of AI Outputs, and for ensuring you have the rights to any input content. AI Outputs may be inaccurate and are not a substitute for professional advice. We reserve the right to filter, restrict, or refuse outputs, and to remove content or suspend accounts that violate these Terms. Repeated infringement may result in permanent account termination.

5. Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by Engs.today and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You may not resell, redistribute, or reverse-engineer the Service. You retain ownership of the journal entries you write; you grant us a limited license to host and process that content solely to provide the Service to you.

6. Payment, Subscriptions & Billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically until canceled. You can manage or cancel your subscription at any time through your account or via paddle.net.

7. Service Availability

We do not guarantee that the Service will be uninterrupted, error-free, or always available. We may modify, suspend, or discontinue features at any time.

8. Suspension & Termination

We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, you may request a copy of your journal data within 30 days, after which it may be deleted.

9. Disclaimers & Warranties

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service shall not exceed the fees you paid to us in the twelve (12) months preceding the claim. We shall not be liable for any indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law (such as fraud, death, or personal injury caused by negligence).

11. Indemnity

You agree to indemnify and hold us harmless from any claims arising out of your content, your unlawful use of the Service, or your violation of these Terms.

12. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after such changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of California, USA. Disputes shall be resolved in the competent courts of that jurisdiction.
